WhisprFree Terms of Use

WhisprFree is free dictation software. These terms are deliberately short. By installing or

using WhisprFree, you agree to them. If you don't agree, don't use it — and if you've already

installed it, uninstalling is the whole of what's required to walk away.

1. What you're getting

WhisprFree turns your speech into text on your own computer and types it into whatever app you

are using. Optional AI cleanup can tidy that text afterward. It costs nothing, requires no

account, and there is no subscription.

2. Two different things, two different sets of rules

the code, and it comes with its own warranty disclaimer. Nothing in these terms takes away

a right the MIT License gives you.

code you downloaded. These terms cover that service. Section 5 applies specifically to it.

3. Your content is yours

You own everything you dictate and everything WhisprFree produces from it. **We claim no rights

of any kind over your words.** We do not use your dictations to train AI models, and we do not

license, sell, or share them. See the Privacy Policy for exactly what is and

isn't transmitted.

4. Accuracy — please read this one

Speech recognition and AI cleanup make mistakes. WhisprFree can mishear words, produce

wrong names or numbers, insert text you did not say, or omit text you did say. AI cleanup can

introduce errors of its own. This is a limitation of the underlying technology, not a defect we

can fully eliminate.

You are responsible for reading and verifying the text before you rely on it. Do not use

WhisprFree, without independent review, for anything where an error could cause harm —

including medical, legal, financial, safety-critical, or contractual content. WhisprFree

provides no warranty of accuracy and is not a substitute for professional transcription

where accuracy is required.

5. The hosted cleanup service is a free courtesy

The hosted cleanup option is provided at our own expense, as a convenience, **with no

guarantee of availability, performance, or continued existence**. We may change its limits,

change or replace the AI provider behind it, pause it, or discontinue it entirely, at any time

and without notice.

There is a monthly free-usage allowance per installation. If you exceed it, or if the service

is unavailable, WhisprFree inserts your unedited transcript instead — **your dictation is never

lost because cleanup was unavailable.**

If hosted cleanup ever ends, the rest of WhisprFree keeps working exactly as it does today:

unlimited local dictation, and unlimited AI cleanup using your own API key. Free local

dictation is the promise; hosted cleanup is a bonus on top of it.

6. Fair use

Please don't: use WhisprFree for anything unlawful; attempt to overload, abuse, or circumvent

the limits of the hosted cleanup service; or use automated means to consume it beyond ordinary

personal dictation. We may block an installation that does. We may also apply reasonable rate

limits to keep the service available for everyone.

7. Third-party services

If you use your own API key, or use hosted cleanup, your text is processed by a third-party AI

provider under their terms and privacy policy. We are not responsible for those services,

their availability, their output, or their handling of your data. Choosing a provider is your

decision.

8. No warranty

WhisprFree is provided "as is" and "as available", without warranty of any kind, express or

implied, including any implied warranties of merchantability, fitness for a particular purpose,

accuracy, or non-infringement. We do not warrant that WhisprFree will be uninterrupted,

error-free, secure, or that it will meet your requirements.

9. Limitation of liability

**To the maximum extent permitted by law, we are not liable for any indirect, incidental,

special, consequential, punitive, or exemplary damages, or for any lost profits, lost data,

lost business, or costs of substitute services, arising out of or relating to WhisprFree** —

including any damages arising from inaccurate transcription or cleanup, text inserted into the

wrong place, or the unavailability of any feature.

**To the maximum extent permitted by law, our total aggregate liability for all claims relating

to WhisprFree is limited to the greater of (a) the total amount you have paid us for

WhisprFree in the twelve months before the claim, or (b) US $50.** For most users, (a) is zero:

WhisprFree is free.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of

certain damages, so parts of sections 8 and 9 may not apply to you. Nothing in these terms

limits liability for fraud, or for death or personal injury caused by negligence, where the law

does not permit that limitation.

10. Age

WhisprFree is not intended for children under 13. By using it you confirm you are at least 13

years old, or that a parent or guardian has agreed to these terms on your behalf.

11. Changes to these terms

We may update these terms. Material changes will be reflected in the effective date above and

noted in the app's release notes. Since we hold no accounts and cannot contact you, continued

use after an update means you accept the current version, which always lives at

whisprfree.com.

12. Ending

You can stop using WhisprFree at any time by uninstalling it. We may block access to the

hosted cleanup service for abuse or misuse under section 6; we cannot and will not disable

the software on your machine, and your ability to use the MIT-licensed code is not affected.

13. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its

conflict-of-laws rules, and the state and federal courts located in California will have

jurisdiction — except where the mandatory law of your country of residence gives you the right

to bring proceedings, or requires the application of local law, in which case that applies.
